These Terms of Use ("Terms") govern your use of the Appos, LLC (“Appos”) website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you have the legal capacity and authority to enter into these Terms.

2. Account Registration and Security

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate and complete information during the registration process.
  • Keep your account information up-to-date.
  • Maintain the security of your account and accept all risks associated with unauthorized access.

3. Subscription and Payment Terms

Certain features may require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees per the billing terms in effect at the time of subscription.
  • Authorize Appos to charge your payment method.
  • Acknowledge that subscription fees may change with prior notice to you.

4. Acceptable Use Policy

You agree to comply with all applicable laws and avoid any misuse of the Service. You also agree not to:

  • Infringe on the intellectual property rights of Appos or third parties.
  • Attempt unauthorized access to the Service or disrupt other users' experience.
  • Upload malicious content or engage in harmful activities that could damage the Service.

5. Intellectual Property

Appos and its licensors retain all rights, title, and interest in the Service, including but not limited to software, designs, text, images, and other content. You may not reproduce or distribute content provided through the Service without Appos' authorization.

6. Service Level Agreement (SLA)

This Service Level Agreement (SLA) outlines service expectations, including uptime guarantees and response times for support.

6.1 Availability:

Appos aims for a 90.0% uptime monthly (allowing 72 hours max downtime).

  • Scheduled Maintenance: Customers will receive a 24-hour notice for maintenance periods.
  • Exclusions: Downtime caused by force majeure or third-party issues does not count toward uptime calculations.

6.3 Service Credits:

If uptime is below 90.0% monthly, you may qualify for partial credits as follows:

  • 85.0%-89.9%: 10% credit.
  • 80.0%-84.9%: 25% credit.
  • Below 80.0%: 50% credit.

To request credits, submit a claim within 30 days of the affected month.

7. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. Appos disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

Appos is not liable for indirect, incidental, or consequential damages. Total liability is limited to fees paid within the preceding 30 days.

9. Indemnification

You agree to indemnify and hold Appos harmless from claims, damages, or expenses related to your violation of these Terms or misuse of the Service.

10. Termination

Appos reserves the right to terminate your account or access for any breach of these Terms. Upon termination, all rights granted under these Terms cease immediately.

11. Governing Law and Dispute Resolution

These Terms are governed by Utah law. Any disputes shall first undergo informal negotiations. If unresolved, disputes will be resolved via binding arbitration in Washington County, Utah.

12. Modifications to the Terms

Appos may update these Terms periodically. Continued use of the Service after updates signifies acceptance of the changes.
